The petitioner apprehends his arrest in connection with Saraiya (Jaintpur O.P.) P.S. Case No. 425 of 2021 registered for the offence under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of 70 litres of illicit liquor has been made from Bhathi situated in a bamboo clump. Petitioner has been named by the accused person, namely, Jitendra Kumar in his self-inculpatory statement.

In view of the allegations levelled against the petitioner, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the

Patna High Court CR. MISC. No.19465 of 2022(2) dt.22-04-2022 2/2 case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
