Petitioner is seeking anticipatory bail in connection with Teghra P.S. Case No. 375 of 2018 dated 03.10.2018 registered for the offences punishable under Section 30 (a) (b) of the Bihar Prohibition and Amendment of Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has got clean antecedent but his name has been involved in the present case on the information allegedly supplied by the local 'Chowkidar'. Learned counsel submits that nothing incriminating has been recovered from the possession of the petitioner and the entire involvement of the petitioner is based on a mere suspicion.

It is further submitted that the co-accused, Ramashray

Patna High Court CR. MISC. No.17247 of 2019(2) dt.01-04-2019 2/2 Singh has been granted anticipatory bail by a learned Coordinate Bench of this Court in Cr.Misc. No.8660 of 2019. Learned APP for the State is present and has opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case, wherein nothing is said to have been recovered from the possession of the petitioner and that he is a man of no criminal antecedent, let in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Teghra P.S. Case No. 375 of 2018. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
