2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Jaynagar P.S. Case No. 49 of 2023 registered for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.
3. The allegation against petitioner is to commit murder of the daughter of the informant who is the wife of the accused petitioner, where the occurrence is alleged to be arises out of matrimonial dispute/family
Patna High Court CR. MISC. No.20603 of 2024(3) dt.12-07-2024 2/3 quarrel, where occurrence took place after 15 years of the marriage.
4. It is submitted by learned counsel by the petitioner that the petitioner is the father-in-law and living separately much before the present occurrence and as such having no connection with the daily and domestic affairs of the daughter of the informant and her husband. It is pointed out that the thrust of allegation as per narration of FIR is available against the husband of the deceased who is now in custody. While concluding argument, it is submitted that the allegation appearing is general and omnibus against the petitioner who is a man of clean antecedent.
5. Learned APP opposes the prayer of bail.
6. In view of aforesaid factual submission it appears that implication of this petitioner prima-facie is for the reason that he is father-in-law of the deceased, coupled with the fact that petitioner appears living separately with the deceased and her husband,
Patna High Court CR. MISC. No.20603 of 2024(3) dt.12-07-2024 3/3 accordingly, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Madhubani/concerned Court, where the case is pending in connection with Jaynagar P.S. Case No. 49 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
