The petitioner apprehends his arrest in a case under Section 353, 406 of the Indian Penal Code and under section 45(A) and (B) of the Bihar Co-operative Societies Act. The petitioner was elected Chairman of Shobhepur Primary Agriculture Credit Co-operative Society. He did not receive anything on being elected. The petitioner lost the election. Since the petitioner did not receive any material or document at the time of his assuming charge as Chairman of the PACS therefore he did not hand over charge to his successor. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned

No.31084 of 2015 (2) dt.30-07-2015 2/2 court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vivek Rai, learned Judicial Magistrate, 1st class, Saran at Chapra in Bheldi P.S. Case No. 59 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
