Case No.46 of 2014 registered for the offences punishable under Sections 302, 201 read with 34 of the Indian Penal Code. Apprehending their arrest, the petitioners filed ABA No.398 of 2014 before the Sessions Judge, Munger. The same was rejected on 19.08.2014. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The allegation against the petitioners is no doubt serious and offence punishable under Section 302 of the Indian Penal Code is alleged. The fact, however, remains that the deceased is none other than the son of the petitioner no.2.
Patna High Court Cr.Misc. No.39326 of 2014 (3) dt.10-04-2015 2/2 Petitioners 1 and 3 are the close relatives. It is difficult to imagine that mother would kill her son, for whatever reason. Hence, this application is allowed. In the event of arrest, the petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Munger in connection with Sangrampur P.S. Case No.46 of 2014, subject to the conditions as laid down under Section 438 (2) Cr. P.C. (L. Narasimha Reddy, CJ) Sunil/- U T
