The petitioner is in custody since 22.09.2017 in connection with Bettiah Muffasil P.S. Case No. 383/2016 registered for the offences punishable under Sections 302 of the Indian Penal Code.
Diary in this case was called for which has since been received.
After hearing learned counsel for the petitioner and learned counsel appearing on behalf of the State and after perusal of the postmortem report, the allegations as made out in the First Information Report, do not indicate that there was any marked injury on the neck of the deceased, save and except an abrasion. Thus, the serious cloud is cast on the prosecution story.
