JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Marhowrah P.S. Case No. 303 of 2017 instituted for the offences under Sections 188, 272, 273, 308/34 of the Indian Penal Code and Section 30, 30(a), 33, 38(i) of the Bihar Prohibition of Excise Act, 2016.

The allegation in the present case against the petitioner is regarding recovery of country made wine (sprit) etc. from one Wagon R car and from the premises of the accused persons. The learned counsel for the petitioner submits that the petitioner was not apprehended either from the aforesaid premises, which is place of occurrence or from the said car and he has been

Patna High Court Cr.Misc. No.60709 of 2017 (2) dt.21-12-2017 2/2 falsely implicated in the present case. It is submitted that the petitioner is in custody since 17.11.2017 and as far as his antecedent is concerned, three other case of same and similar nature are pending against him.

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 50,000/- (rupees fifty thousand) with two sureties of the like amount each to the satisfaction of leaned Additional District and Sessions Judge-6th, Saran at Chapra in connection with Marhowrah P.S. Case No. 303 of 2017.
