JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-11-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner is languishing in jail custody since 14.09.2019 in connection with Laukahi P.S. Case No. 192/2019 registered under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of Arms Act.

It appears from perusal of written report that there was some dispute between the petitioner and the deceased on issue of partition. Moreover, not a single prosecution witness claims that it was the petitioner who shot fire on the deceased and the prosecution witnesses claimed that petitioner entered into conspiracy of killing of the deceased.

Patna High Court CR. MISC. No.20827 of 2020(3) dt.02-11-2020 2/2 Learned counsel appearing for the petitioner submits that co-accused Laxmi Mehta, who happens to be father of the petitioner, has already been granted privilege of bail by this Court.

Investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. 1st, Jhanjharpur in connection with Laukahi P.S.
