The petitioners seek bail in a case instituted for the offences under Sections 363 and 367 of the Indian Penal Code. Prosecution case, in short, is that accused persons with an intention for marriage abducted the son of the informant. It has been submitted on behalf of the petitioners that the petitioner nos. 1 and 2 are in custody since 11.5.2018 and 21.5.2018 respectively and have got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. Petitioner no. 1 is the father and
Patna High Court Cr.Misc. No.50401 of 2018(2) dt.14-09-2018 2/2 petitioner no. 2 is brother-in-law of girl namely Khusbu Kumari. The boy is said to have eloped with said girl Khusbu Kumari. Later on, the boy was recovered. It is a case of love affairs. On behalf of the State, it is submitted that the petitioners are named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Divya Prakash, Judicial Magistrate, 1st Class, Purnea in connection with Tikapatti P.S.
