The petitioner in the present case is seeking pre-arrest bail in connection with Dumariya Ghat P.S. Case No.173 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report. His name has transpired in the confessional statement of the co-accused and for that reason alone the name of the petitioner has been involved in this case.

Learned APP for the State submits that the name of the petitioner has been disclosed by his accomplice and it would appear from paragraph '3' of the present application that the petitioner has at least 4 nos. of cases of similar nature against him, therefore, he seems to have got involved repeatedly in commission of the same offence.

No.17396 of 2020(2) dt.21-07-2020 2/2 Having regard to the facts and circumstances of this case wherein the name of this petitioner has not only transpired in the confessional statement of the co-accused rather it appears from the records that the petitioner has got criminal antecedent of at least 4 cases of similar nature, this Court is not inclined to grant privilege of pre-arrest bail to the petitioner. His prayer is thus, refused. This application stands dismissed.
