1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Maharajganj Police Station Case No. 12 of 2022, dated 10.01.2022, disclosing offences under Sections 341/323/324/307/379/504/34 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that on 08.01.2022, while the informant was sitting at his door, his neighbour, co-accused Sheonath Sing, along with his son i.e. the petitioner, came there, abused and pushed him on the ground. Thereafter, co-accused Sheonath Singh asked the petitioner to bring dab with which the petitioner assaulted the informant on his head due to which he sustained injury.

Learned counsel for the petitioner submits that both the parties are co-sharer and there is land dispute between the father of the petitioner and informant, who is also cousin of the petitioner's father. He next submits that the petitioner is a Special Education Teacher posted at Government Boys Senior Secondary School, West Patel Nagar, Delhi, and he has falsely been implicated in the present case only to trouble him. The petitioner was not present at the place of occurrence, which would be evident from the CCTV footage of the area and live location of the petitioner's mobile which has come during the course of investigation. He further submits that after investigation, the police has submitted final form against the petitioner not sending him for trial. The petitioner's father has been granted anticipatory bail by learned Court below itself. Learned counsel also submits that injuries sustained by the informant is simple in nature.
5. On the other hand, learned counsel for the informant vehemently opposes the anticipatory bail and submits that there is specific allegation of assault on the informant's head by means of dab against the petitioner and the injury sustained by the informant is on vital part of the body.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neighbours having land dispute between them and injury sustained by the informant is caused by hard and blunt substance and is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate V, Siwan, in connection with Maharajganj Police Station Case No. 12 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
