Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 5.9.2017 passed in Cr. Misc. No.36165 of 2017, with an observation that he may renew his prayer for bail after framing of charge or after completion of the six months' period in custody.
Submission of the learned counsel for the petitioner is that he has completed six months' period in custody and ready to abide by any condition imposed upon him.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty
Patna High Court Cr.Misc. No.37 of 2018 (2) dt.03-01-2018 2/2 Five Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhepura in connection with Kumarkhand P.S.Case No.165 of 2016 dated 20.9.2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
