The case was taken up on several occasions, detailed order was passed on 20.03.2023, thereafter, the matter was taken up on 24.03.2023 when the District Co-operative Officer,

Patna High Court CWJC No.4007 of 2023(6) dt.04-04-2023 2/3 Begusarai, was directed to remain physically present in the Court on 27.03.2023. The case, thereafter, was taken up on 27.03.2023 when the District Co-operative Officer, Begusarai was present and he gave an undertaking that all the formalities with regard to the conducting election of the society would be done within two days and the requisition would be sent to the State Election Authority for conducting the election. Thereafter, the matter was taken up on 29.03.2023 when in compliance of the order dated 27.03.2023, the State filed a supplementary counter-affidavit on behalf of the respondent No. 4, wherein, it was specifically stated at Para 5 that respondent No. 4, the District Co-operative Officer, Begusarai has sent the requisition/proposal on 28.03.

2023 to the Secretary, Bihar State Election Authority through online process and offline proposal has been sent through E-mail vide letter No. 257 dated 28.03.2023 for conducting the election of the Board of Directors, Begusarai, Central Co-operative Bank Ltd. When the matter was taken up on 29.03.2023, a submission was made on behalf of the learned counsel for the petitioner that no doubt, the requisition/proposal has been sent by the D.C.O.

Patna High Court CWJC No.4007 of 2023(6) dt.04-04-2023 3/3 Election Authority to delay the conduct of the election, on which the learned counsel for the State Election Authority had submitted that the apprehension of the learned counsel for the petitioner was unfounded.

Today, when the matter is taken up, the learned counsel appearing for the State Election Authority produces letter No. 668 dated 31.03.2023 issued by the Secretary, Bihar State Election Authority and submits that now the process for conducting the election has been initiated.

The grievance of the petitioner thus stands redressed. In view of the specific submission made by the learned counsel appearing for the Bihar State Election Authority, the Court is not inclined to proceed further in the matter. The writ application is disposed of with a direction that the State Election Authority to ensure that the election of the Society is conducted as per schedule.
