JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Leheri P.S. Case No. 136 of 2015, disclosing offences under Sections 420/34 of the Indian Penal Code. Despite the submission made on behalf of the petitioner that there is no allegation against him except confessional statement of the co-accused, who was apprehended by the police, I am not inclined to grant the petitioner the privilege of anticipatory bail, keeping in mind

Patna High Court Cr.Misc. No.32063 of 2015 (2) dt.12-08-2015 2/2 the gravity of the offence. Allegedly, from the possession of the co-accused, 21 A.T.M. Cards were recovered and the apprehended co-accused is said to have disclosed the name of this petitioner as gang leader, involved in commission of offence of withdrawal of money by using different A.T.M. Cards.

Accordingly, this application for anticipatory bail is, hereby, rejected.

The petitioner is directed to surrender before the court below within six weeks and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
