The petitioner seeks regular bail in connection with Special Case No. 434 of 2017 arising out of Kishanganj P.S. Case No. 541 of 2017 instituted for the offences under Section 30(A) of the Bihar Excise Prohibition Act, 2016.

The allegation is regarding recovery of 14.850 litres of illicit liquor from a tempo in which the petitioner is said to be travelling as a co-passenger.

The learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said Auto and he was merely a co-passenger. It is submitted that the petitioner has a clean antecedent and he is in custody 10.10.2017. Considering the nature of accusation, the period of

No.63238 of 2017 (2) dt.17-01-2018 2/2 custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge (Excise), Kishanganj in connection with Special Case No. 434 of 2017 arising out of Kishanganj P.S. Case No. 541 of 2017.
