The petitioner seeks bail in connection with Dalsinghsarai P.S. Case no. 24 of 2013 registered for the offence punishable under Sections 224, 225(A), 225(B), 427 and 328/34 of the Indian Penal Code.

The petitioner is said to have absconded from the Sub Divisional Jail, Dalsinghsarai by cutting the rod of the window of the prisoner ward.

It is submitted by the learned counsel for the petitioner that co-accused namely, Savindra Kumar Sharam @ Sarvind Kumar Sharma who had also escaped from the jail has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 01.11.2013 passed in Cr. Misc. no. 34652 of 2013.

Patna High Court Cr.Misc. No.56728 of 2017 (2) dt.29-11-2017 The petitioner has been languishing in custody since 16.05.2017. Earlier, the bail petition of the petitioner was rejected with liberty to renew the same after framing of charge and the charge in the case has already been framed on 13.10.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Samastipur in connection with Dalsinghsarai P.S. Case no. 24 of 2013.
