In this case, the petitioners are seeking regular bail in connection with Ramgarh (Nuaon) P.S. Case No. 303 of 2019 registered for offence punishable under section 366 (A)/34 of the Indian Penal Code.

In the allegation, it has been alleged that both petitioners enticed and kidnapped the victim girls for the purposes of marriage and both of the girls were put to fear and they were sexually assaulted by the petitioners and entered into marriage.

This Court has issued notices to opposite party nos. 2

Patna High Court CR. MISC. No.20678 of 2020(9) dt.17-02-2021 2/2 and 3 but they did not appear either through themselves or through their guardian and the service report shows that the notices were individually served upon them.

Learned counsel for the petitioners submits that the petitioners are in custody since 29.12.2019, having clean antecedent.

Looking to the facts and circumstance of the case, let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Ramgarh (Nuaon) P.S. Case No. 303 of 2019, subject to the condition that one of the bailors of the petitioners shall be their close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
