2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 34 of the Indian Penal Code and Section 27 of Arms Act.
3. As per the prosecution story, on 17.09.2023 the petitioner along with one Rahul threatened to kill informant and also made firing. Informant raised suspicion that the life of informant as well as his family members is in danger and if anything happens the petitioner and other co-accused persons would be liable for that.
4. It is submitted by learned counsel for the petitioner that as per the FIR, allegation is that the petitioner alongwith co-accused Rahul threatened the informant and made firing. But no fire arm injury was sustained to the informant and firing
Patna High Court CR. MISC. No.22237 of 2024(2) dt.04-04-2024 2/2 allegation is also false and concocted. Petitioner has three criminal antecedents as mentioned in para-3 of this application.
5. Learned APP for the State opposed the prayer for bail.
6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Sultanganj P.S. Case No. 462 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
