This is an application for regular bail in connection with Sultanganj P. S. case no. 213 of 2015 registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code.
Allegation is that petitioner along with two other accused persons, who were running an organized criminal group and they used to cheat banks and their account holders. It is also alleged by informant that total amount of Rs. 9,85, 550/- through three different cheques was transferred in the account of another person from the school's Savings Bank Account by the petitioner.
It is submitted on behalf of the petitioner that he is innocent as he is not concerned with such incident. Such
Patna High Court Cr.Misc. No.436 of 2018(2) dt.17-01-2018 2/2 amount has been transferred with the involvement of bank employees. Petitioner has falsely been implicated in the present case. He is in custody since 08.03.3016.
Learned counsel for the State opposed the prayer for bail submitting that petitioner's involvement in the alleged crime cannot be ruled out as it is evident from the CCTV footage of the bank.
Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner, same is rejected. However, if trial of the petitioner in connection with Sultanganj P. S. Case No. 213 of 2015 pending in the court of ACJM-VIth , Patna City, is not concluded within a period of six months from today, petitioner will be at liberty to renew his prayer for bail. (S.
