JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-01-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Parkaridayal P.S.Case No. 121 of 2016 instituted for the offence punishable under Sections 147, 148, 149, 302, 307, 120 (B)/34 of the Indian Penal Code and Section 27 of Arms Act, pending in the court of the learned 12th Additional Sessions Judge, East Champaran, Motihari. The prayer of the bail of the petitioners was earlier refused by this Court vide order dated 17.03.2017 passed in Cr. Misc. No. 11231 of 2017.

Submission is that there is general allegation against

Patna High Court Cr.Misc. No.55667 of 2017 (2) dt.24-01-2018 2/2 the petitioners and three other accused to make firing through Katta with specific allegation against accused, Rakesh Singh to fire through carbine in which four persons died. The petitioners are in custody since 28.08.2016.

Having considered nature of offence and the allegation against the petitioners, I find no reason to reconsider the prayer for bail of the petitioners. Accordingly, the prayer for bail of the petitioners is rejected.
