There is a direct evidence of linking the petitioner with allegation of assault upon the informant. There is adequate evidence in this regard emerging even from the injury caused upon the informant. Therefore, a clear cut case is made out so far as this petitioner is concerned with the allegation and the charges of Section 307 against him. This is adequate reason for not granting the benefit of anticipatory bail.

Anticipatory bail application of the petitioner is hereby rejected in connection with Bettiah Town P.S. Case No. 49 of 2012 pending in the Court of Chief Judicial Magistrate, West Champaran at Bettiah.

Patna High Court Cr.Misc. No.38397 of 2014 (2) dt.13-03-2015 Let him surrender and pray for regular bail.
