Petitioner is an accused in a case registered for offence under section 25(1-B)A/26/35 of the Arms Act. It is submitted on behalf of the petitioner that the allegations made against the petitioner are false and the alleged recovery of one country made pistol is not supported by legal seizure. Petitioner is in custody in connection with this case since 15.3.2018. Prior to lodging of this case, petitioner is a man of clean antecedent.
Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.50817 of 2018 (2) dt.19-09-2018 2/2 satisfaction of Sub Divisional Judicial Magistrate, West Muzaffarpur in PS.Case No. -112 Year- 2018 Thana -Kanti Tharmal Power District- Muzaffarpur on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
