JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-07-2021 Heard learned counsel appearing for the petitioner nos. 1 and 3, namely, Gandhi Tiwari @ Vicky Tiwari @ Vicky Kumar Tiwari and the learned Additional Public Prosecutor appearing for the State through Video Conferencing. This application has been filed for modification of order dated 26.06.2020 passed in Criminal Misc. No. 82244 of 2019.
Learned counsel for the petitioners submits that vide order dated 26.06.2020 passed in Criminal Misc. No. 82244 of 2019, the petitioner nos. 1 and 3, namely, Gandhi Tiwari and
Patna High Court CR. MISC. No.25129 of 2021(2) dt.28-07-2021 2/2 Vicky Tiwari @ Vicky Kumar Tiwari were ordered to be released on bail in the event of arrest or surrender before the court below within a period of four weeks in connection with Inarwa P.S. Case No. 31 of 2019, pending in the court of learned Judicial Magistrate Ist Class, Bettiah, West Champaran, but due to pandemic of Covid-19, petitioner nos. 1 and 3, namely, Gandhi Tiwari and Vicky Tiwari and Vicky Kumar Tiwari could not surrender before the court below within the stipulated time. In view of the above submission, the period of surrender of petitioner nos. 1 and 3, namely, Gandhi Tiwari and Vicky Tiwari @ Vicky Kumar Tiwari is extended for further six weeks from today. The order dated 26.06.2020 passed in Criminal Misc. No. 82244 of 2019 is modified to the said extent.
