JUSTICE RAVI RANJAN ORAL ORDER 14-07-2015 I have heard learned counsel for the petitioner, the State and the Accountant General.

It is contended on behalf of the petitioner that her husband died in harness on 11.02.2015 putting the family in much hardship. Petitioner submits that she has not been given the retiral benefits such as Gratuity, Provident Fund and Family Pension etc. It is contended that she had approached the Headmaster of the School by filing a representation appended as Annexure-5. She has also approached the District Programme Officer (Establishment), Jehanabad but nothing could be done till date. Having regards to the aforementioned facts and

Patna High Court CWJC No.10094 of 2015 (3) dt.14-07-2015 2/2 circumstances, this Court would be inclined to dispose of the present writ application directing the petitioner to appear before respondent no.3, i.e., the District Programme Officer (Establishment), Jehanabad along with a fresh representation and a copy of this order. On filing of the aforesaid representation, the District Programme Officer would be obliged to ascertain that all the formalities are completed. He would take immediate steps for sanction of the retiral benefits admissible to the petitioner. If certain papers are to be placed through Head Master, Machhil then he would ascertain that the same is done. Appropriate decision should be taken by the State authority by sanctioning the admitted retiral dues within a period of eight weeks, thereafter, the matter for which authorization of Accountant General is required should be immediately forwarded to the respondent no.6 who shall issue such authorization letter in accordance with law within a further period of four weeks.
