The petitioner seeks bail in Palasi P.S. Case No. 172 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

One country made pistol is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has been falsely implicated in the case by the informant due to animosity. The alleged fire arm was not seized from the possession of the petitioner by the police rather it was seized by the informant and

Patna High Court Cr.Misc. No.54011 of 2017 (2) dt.13-11-2017 2/2 produced before the police. The petitioner has been languishing in custody since 07.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Araria in connection with Palasi P.S. Case No. 172 of 2017.
