2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 395 , 397 and 412 of the Indian Penal Code and section 27 of Arms Act.

3. As per F.I.R., five unknown criminals entered the bank and looted Rs. 2,23,675/-, many mobiles and laptop and escaped firing.

4. It is submitted on behalf of the petitioner that he has not been named in the F.I.R., and his name has transpired on the basis of confessional statement of co-accused namely Bhola Pandit which has got no evidentary value . Except confessional statement there is no other material available on record to show

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate , Bhagalpur in connection with Kahalgaon P.S. case No. 460 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
