JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 326, 307, 120B, 448 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that co-accused Nand Lal Prasad and Manish Kumar (non-petitioners) assaulted the uncle of the informant namely Ram Bali Das with garasa who subsequently succumbed to the injuries. It is alleged against the petitioner Sunil Kumar and Satendra Kumar including twenty unknown persons that they resorted to fire and assaulted the family members of the informant.

It is submitted by learned counsel for the petitioners that

No.32234 of 2015 (2) dt.11-08-2015 2/2 the accusation of assault to the victim is against Nand Lal Prasad and Manish Kumar and accusation of firing is alleged against petitioner nos. 2 and 3 but none of the injured received any firearm injury and accusation of assault is omnibus and general. Moreover, injuries of other injured have been found to be simple in nature. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Hajipur, Vaishali in connection with Mahnar P.S. Case No. 253 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
