JUSTICE PURNENDU SINGH ORAL ORDER 23-04-2025 Heard Mr. Ashok Kumar Yadav, learned counsel appearing on behalf of the petitioners and Mr. Pradeep Narain Kumar, learned APP appearing on behalf of the State.
2. The petitioners apprehend their arrest in connection with Saharsa P.S. Case No. 1046 of 2024 registered under Sections 406, 420, 386, 387, 463 and 34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioners along with some other persons received an amount of Rs.35,00,000/- from the informant out of consideration amount

No.21623 of 2025(2) dt.23-04-2025 2/3 of Rs.65,00,000/-, fixed between them on the pretext of sale of a piece of land measuring about 3 Katha and 4 Dhurs, but the petitioners neither registered the land in question, in the name of informant, nor they have returned the aforesaid amount to the informant.

Learned counsel appearing on behalf of petitioners has informed that the petitioners have instructed him that both the parties want to negotiate the matter, as petitioners are willing to register the land in the name of the informant. He further submitted that the matter may be referred to the District Mediation Centre, Saharsha for amicable settlement of dispute between the parties.
5. Considering the aforesaid submissions made on behalf of the petitioner, the matter is referred to the District Mediation Center, Saharsha for amicable settlement between the parties.
6. Learned District Court is directed to fix a date of appearance of the parties before the learned Mediator.
7. Thereafter, learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute amicably, also taking into account the law laid down by the Apex Court in case of Bimla Tiwari vs. State of
Patna High Court CR. MISC. No.21623 of 2025(2) dt.23-04-2025 3/3 Bihar & Ors. passed in SLP (Crl.) Nos. 834-835 of 2023 and submit his/her report before the concerned learned District Court, well within a period of one month.
8. In the meantime, no coercive steps shall be taken against the petitioners in connection with the aforesaid case.
9. Accordingly, the present bail application stands disposed of.
