Petitioner seeks bail in a case registered for the offences punishable under Sections 307/342/120B/34 of the Indian Penal Code and 27 of Arms Act and later on Section 324 of the Indian Penal Code was added. Though three persons were on the motorcycle but the informant could not see who had caused firearm injury or that the petitioner was also on the same motorcycle.
Submission is that only on suspicion, the petitioner has been named. Petitioner is accused only in one case which was registered under the Excise Act. Petitioner is in custody since 24.09.2017.
Considering the aforesaid submission, let the
Patna High Court Cr.Misc. No.62876 of 2017 (3) dt.17-02-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ara Nawada Police Station Case No.413 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
