The prayer for bail of the petitioner was refused twice on 30.06.2017 and 256.07.2018 vide order passed in Cr. Misc. No. 19735 of 2017 and Cr. Misc. No. 13902 of 2018 respectively taking into consideration the direct allegation against the petitioner to shot fire at the deceased. The learned counsel appearing for the petitioner submits that the petitioner is in custody since 24.12.2016. A report, vide letter no. 47, dated 20.05.2019, has been received regarding the stage of trial from the Additional District & Sessions Judge, III, Naugachia, which shows that out of ten, six witnesses have already been examined, summon has been issued to remaining witnesses and learned Additional District & Sessions Judge stated that the trial would be

Patna High Court CR. MISC. No.24135 of 2019(3) dt.03-07-2019 2/2 concluded within six months, if the prosecution cooperates with the case.

Having regard to the facts and circumstances of the case and the nature of allegation, I am not inclined to reconsider the prayer for bail of the petitioner.

The prayer for bail is rejected.

However, the Additional District & Sessions Judge, III, Naugachia, is directed to conclude the trial within six months by taking all effective steps.
