JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Chenari PS Case No. 175 of 2017 registered under Sections 366A, 34 of the IPC. The allegation is that the informant's daughter became trace less in the mid night and later on recovered from the house of the petitioner.
Learned Counsel for the petitioner submits that the girl's statement was recorded under Section 164 Cr.P.C. but she has not stated that any force was applied to bring her to the house of the petitioner, the Medical Board has found her major and there is no allegation or evidence regarding her sexual exploitation. The petitioner is in custody since 8.8.2017.
Having considered the said facts and circumstances, the petitioner, namely, Om Prakash Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM III Sasaram in connection with Chenari PS Case No. 175 of 2017.
