The petitioner seeks bail in a case registered under Sections 323, 341, 365, 379, 504, 511/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner along with 5-6 unknown persons tried to kidnap the informant and petitioner took away Rs.20,000/- and a golden chain from him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.07.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The wife of the petitioner was elected to the post of Pramukh. The election was
Patna High Court Cr.Misc. No.50325 of 2018(2) dt.13-09-2018 2/2 happened due to no confidence motion. The allegation is of making attempt to kidnap the informant. Due to political rivarly between the parties the present case has been instituted. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Koransarai P.S. case No.77 of 2018.
