JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-03-2023 The present writ petition has been filed seeking the following reliefs:- "1. For issuance of an appropriate writ(s) for a direction to not construct Police Club, Jehanabad in Khata No. 191 Khesra No. 815 area 63 decimals in Mauza Aarki thana No.346 Jehanabad belongs to the petitioner, which was purchased by his father in the year 1944 through registered sale deed from one Pitamber Gope Khatiani Malik and since then he has been coming in peaceful possession till date.

The District Magistrate, Jehanabad on 16.2.2013 in letter No.252 sanctioned for transfer of land situated in Mauza Iraki Thana No.346,

Patna High Court CWJC No.10067 of 2015(2) dt.27-03-2023 2/2 Khata No.460, Khesra No. 792,793 and 794 for an area 0.02, 0.06 and 0.16% (part) total 0.24% Gairmazarua land for construction of Town Thana building but the respondent is going to construct Police Club on the land of petitioner situated in another plot in Khata No.191, Khesra No.815.

(ii). For a direction to the respondent to remove the raw material bricks, stone chips etc. which has been kept on the land of petitioner for construction of police club."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
