The petitioner apprehends his arrest in a case registered for the offence under Sections 25(1-b)A/26(i)(ii)/35 of the Arms Act.
It is submitted on behalf of petitioner that neither petitioner is named in the F.I.R. nor anything has been recovered from his possession. Name of petitioner transpired only due to the fact that other F.I.R. named accused person, who were caught with arms & ammunition, were travelling on the motorcycle, which was registered in the name of this petitioner. As a matter of fact, co-accused Udlesh Kumar, who is covillager of petitioner, had taken the motorcycle of petitioner in good faith and petitioner had no knowledge about the alleged occurrence. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.19585 of 2022(2) dt.31-08-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 146 of 2021 (G.R. Case No. 353A/2021), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
