The petitioner seeks bail in a case registered under Sections- 302, 147, 148, 149 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, in brief, is that the accused persons including the petitioner opened fire on the brother of the informant, as a result of which, the informant's brother succumbed to the injuries.
Earlier taking into account that in course of occurrence, the petitioner is alleged to have fired upon the deceased, prayer for bail of the petitioner was rejected vide Annexure-1 to the present application.
Patna High Court Cr.Misc. No.50658 of 2018 (2) dt.18-09-2018 Considering the nature of allegation, levelled against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Khodawandpur P.S. Case No. 131 of 2016 is again rejected. (Sudhir Singh, J) A.K.V./- U T
