JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 19-12-2017 Heard learned counsel for the petitioners as well as learned APP.

Informant at 9:45 PM was going outside his office premise for medicine and reached near gate of godown, Ajay Rai, Raushan Rai, Ranjan Rai, Santosh Rai lifted him and took him away over I10 vehicle bearing Registration No. BR06E-5000 towards Mansurpur. They took him to Petrol Pump lying at Village- Telia Sarai where, Satya Narain Rai (petitioner), Ram Narain Rai (petitioner), Deep Narain Rai (petitioner), Subesh Rai, Bipin Rai were present. Then all of them damaged his vehicle. They took him out of the vehicle and assaulted with rod. At that very time, Ajay was armed with pistol.

During course of consideration of prayer for bail on

Patna High Court Cr.Misc. No.61968 of 2017 (2) dt.19-12-2017 behalf of petitioner, Ajay Rai under Cr. Misc. No. 21329/2017, he was granted bail vide order dated 28.06.2017 and during course thereof, case diary was called for and after perusal of the same, order was passed. After going through the aforesaid order (Annexure-2), it is evident that though grievous injuries have been found over the head of the informant but, there happens to be no specific allegation at his end against any of the accused to be author of the aforesaid injuries. On that very basis, other petitioners were also granted bail vide Cr.Misc. No. 52410/2017 by order dated 21.11.2017.

Accordingly, petitioners, Ram Narain Rai, Satya Narain Rai, Deep Narain Rai are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of ACJM-XIII, Vaishali at Hazipur in Sarai PS Case No. 135/2016.
