This case is taken up through video conferencing. The petitioner seeks bail in Mokama P.S. Case No.278 of 2019 (Special Case No.10747 of 2019), registered under Sections 414, 420 and 34 of the Indian Penal Code as well as under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act.

The informant, S.H.O. of Mokama P.S., got information that some persons were coming towards Mokama on a Scorpio vehicle and they were carrying liquor. On such, the vehicle was intercepted and three persons, namely, Kumar Gautam @ Gauri Shankar Singh, Chandan Kumar @ Karenta and Vikash Kumar were apprehended. 126 litres of Indian made foreign liquor was recovered from the vehicle. The apprehended accused disclosed that one Gauri Shankar Singh had kept liquor in Jagdamba

Patna High Court CR. MISC. No.16333 of 2020(2) dt.13-05-2020 2/2 Medical Store for sale. On such, Jagdamba Medical Store was searched and 37 bottles each containing 375 m.l. and 6 bottles each containing 750 m.l. Indian made foreign liquor total waighing 18.375 litres was recovered. The apprehended accused further disclosed that Sujit Kumar, the petitioner was also accompanying them but he managed to flee away.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has falsely been implicated in the case. Nothing has been recovered from possession of the petitioner. The petitioner is in jail since 08.01.2020. The petitioner has already remained in jail for more than four months.

Considering the facts aforesaid, petitioner, namely, Sujit Kumar @ Sajit Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, District Patna in connection with Mokama P.S. Case No.278 of 2019 (Special Case No.10747 of 2019).
