JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends her arrest in a case registered for the offence punishable under sections 498(A), 304 (B), 302, 201/34 of the Indian Penal Code.

It is a case of dowry death.

Petitioner is the mother-in-law of the informant's niece(deceased).

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is separate in mess and business. Thrust of allegation is against the husband of the deceased who is already in custody. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.18349 of 2023(2) dt.18-05-2023 2/2 of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Ghosi(Okari) P.S. Case No. 497 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
