Petitioner seeks bail in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code.
The F.I.R. relates to offence of kidnapping of the daughter of the informant.
Submission of the learned counsel for the petitioner is that the victim has already appeared and she has refused to give her statement under Section 164 of the Code of Criminal Procedure. In fact the matter is of love affairs between the victim and Milan Kumar, son of co-accused, Mishree Lal Sah. Considering the aforesaid facts, a co-ordinate Bench of this
Patna High Court Cr.Misc. No.50746 of 2018(2) dt.24-08-2018 2/2 Court has granted bail to Rahul Kumar, vide Annexure-2. Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Turkaulia (Raghunathpur) Police Station Case No.179 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
