JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 120B of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 22.02.2022, charge-sheet has been submitted in the case and has antecedent of two cases. Allegation is of recovery of 105.750 litres of liquor. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by the co-accused Ranjit which has no evidentiary value.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.19598 of 2022(2) dt.22-04-2022 2/2 bail of the petitioner.

Considering the fact that the petitioner is in custody since 22.02.2022, charge-sheet has been submitted in the case, was not arrested from the spot and his name was disclosed by the co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Fatuha P.S. Case No. 519 of 2017.
