JUSTICE MADHURESH PRASAD ORAL ORDER 19-09-2018 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is an accused in a case registered for offence under section 395 of the IPC.

It is submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and he has been implicated in this case on the confessional statement made by co-accused Mustaqueem. He submits that the petitioner being a Sarpanch has been implicated in this case due to rivalry and there is no recovery whatsoever from the petitioner so as to implicate him in this case. Petitioner is in custody since 31.5.2018. Prior to the lodging of this case, petitioner is accused in other cases mentioned in paragraph 3 of the bail application and in most of them he is on bail.

Considering the aforesaid submissions, prayer for

Patna High Court Cr.Misc. No.50791 of 2018 (2) dt.19-09-2018 2/2 bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in K.Nagar (Maranga) Police Station Case No. 147 of 2018, GR No.1461 of 2018 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
