Petitioner seeks regular bail in connection with Buxar PS Case No. 59/2022 registered for the offence punishable under Section 30(a) 30(c) of Bihar Prohibition & Excise Act, 2016.

One bottle of beer containing 500 ML along with Homeopathic Medicine has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is a medical representative of Homeopathic medicine and the recovered article from the possession of petitioner was duly purchased from a registered dealer and in support of the same, cash memo, bill etc., has been annexed at Annexure-2.

No.19019 of 2022(2) dt.26-05-2022 2/2 He next submits that the stockist/dealer, namely, Anish Verma from whom the petitioner has purchased the medicines etc., has been granted bail by a Bench of this Court vide Cr. Misc. No. 17184/2022. The petitioner having no criminal antecedent is in custody since 01.02.2022.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated accused person has been granted bail by a Bench of this Court, petitioner having no criminal antecedent is in custody since 01.02.2022 and there is no likelihood that the trial will be concluded in near future, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Court-1st, Buxar in connection with Buxar PS Case No. 59/2022.
