Heard Mr. Subhash Kumar Jha, learned counsel for the petitioner and Mr. Md. Aslam Ansari, learned counsel for the State.

The petitioner, who is in custody since 14.11.2019 seeks bail in connection with Khajauli P.S. Case No. 16 of 2017 dated 03.03.2017 corresponding to C.R. I. No. 313 of 2017 instituted

for the offence under Sections 147, 148, 149, 341, 323, 324, 448, 379, 307, 302 and 504 of the Indian Penal Code. As the prosecution story goes, the petitioner is alleged to have gone in front of the house of the informant a number of times and on protest by the informant, the petitioner along with several persons entered in his house and assaulted the members of the house leading to death of the brother of the informant.

Learned counsel for the petitioner has submitted that no motive has been assigned for the assault and the murder. Apart from this, there is general and omnibus allegation against all the accused persons of assaulting the members of the family of the informant. One of the accused persons of this case having similar allegation, this Court has been informed, has been granted bail by a Bench of this Court.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties

of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Madhubani in connection with Khajauli P.S. Case No. 16 of 2017 .
