Petitioner who is in custody seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

Informant in his fardbeyan has alleged that on 28.11.2020, he on his motorcycle accompanied by his wife and son were going to market then three miscreants boarded on two motorcycle intercepted them and on the strength of arms snatched away golden chain, purse containing Rs. 30,000/- two mobile phones and ATM card and thereafter fled away. It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case on mere

Patna High Court CR. MISC. No.28161 of 2021(2) dt.17-06-2021 2/2 suspicion. The name of petitioner has surfaced in this case on the basis of confessional statement of co-accused Rahul Kumar. Except the said confessional statement there is no any incriminating material against the petitioner. Although petitioner has given vivid description of the miscreants who looted away cash and jewellery but no TIP was done. Petitioner has got no criminal antecedent and is in custody since 23.01.2021. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Lalganj PS Case No. 367 of 2020, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
