In this case, the petitioner is seeking bail in connection with Bhadwar P.S. Case No.19 of 2017, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Earlier, the petitioner had moved before this Court for grant of bail vide Cr. Misc. No.23737 of 2019 and the Court had rejected his prayer for bail vide order dated 08.07.2019 with a direction to the court below to expedite the trial and to conclude the same within a period of nine months, though the court below has reported that the case has been committed to the Court of Sessions on 22.07.2020.

Patna High Court CR. MISC. No.15947 of 2020(4) dt.08-10-2020 2/2 Considering the facts and circumstances of the case, the prayer of the petitioner for grant of bail is again rejected.

However, the trial court is directed to conclude the trial as early as possible preferably within a period of nine months.

It is made clear that if the trial is not concluded within a period of nine months, then the petitioner will be at liberty to renew his prayer for bail.
