Petitioner seeks bail in connection Arariya P.S. Case no. 1046 of 2020 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 20.12.2020 and charge sheet has been submitted and petitioner is person with clean antecedent. From allegation as alleged in the FIR, it would manifest that 3124.800 liter liquor was recovered from a truck. Learned counsel for the petitioner submits that petitioner is owner of the truck and on the fateful day, truck was booked by one Golu as such petitioner was not aware what material was being transported.

Patna High Court CR. MISC. No.27689 of 2021(5) dt.23-11-2021 2/2 Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 20.12.2020 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Arariya in Arariya P.S.
