The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 290 of the Indian Penal Code and Sections 30(a) and 37(e) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 35 litres of "Tadi" was recovered from the shop of co-accused Raju Sah @ Satto where the petitioner is said to be employed as labourer and nothing was recovered from the conscious possession of the petitioner. It is urged that the petitioner has

Patna High Court Cr.Misc. No.56301 of 2017(2) dt.23-11-2017 2/2 remained in custody since 26.09.2017, i.e., about two months. It is claimed that the petitioner is having clean antecedent.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 707 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
