JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-06-2019 An order dated 20.01.2017 passed by the Additional Collector, Muzaffarpur, in Mutation Revision Case No. 21/2013-14 is under challenge in the present writ application. Though the matter has been listed with office notes, pointing out certain defects in filing of the writ application, the matter has been heard on merits.
Patna High Court CWJC No.11742 of 2019(2) dt.17-06-2019 2/2 On perusal of the materials on record, it is evident, which is not in dispute, that against the said order, the petitioner has remedy before the Bihar Land Tribunal under the Bihar Land Tribunal Act, 2009. The writ application is accordingly disposed of with a liberty to the petitioner to approach the Tribunal to question the legality of the order, which is impugned in the present writ application. The order, which is impugned, was passed in 2017. This writ application has been filed in 2019. If the petitioner now approaches the Tribunal, his application will apparently be time barred. It is indicated that the Tribunal may consider the petitioner's application for condonation of delay in the said background and take final decision in accordance with law.
This writ application stands disposed of.
