The petitioner seeks regular bail in connection with Special Case No. 5110 of 2017 arising out of G.R.P. Patna Junction P.S. Case No. 425 of 2017 instituted for the offences under Section 272 of the Indian Penal Code and Section 30(a) of the Bihar Excise Amendment Act, 2016.
The allegation is regarding recovery of 84 liters of illicit country made liquor from the compartment of the railway bogie in which the petitioner is said to be a co-passenger. The learned counsel for the petitioner submits that petitioner was sitting in the same compartment from which the alleged recovery has been made. However, he has got nothing to do with the same and he has been falsely implicated in the present
Patna High Court Cr.Misc. No.61520 of 2017 (2) dt.21-12-2017 2/2 case. It is further submitted that the petitioner has a fair antecedent and he is in custody since 17.08.2017.
Considering the nature of accusation and the period of custody already undergone by the petitioner herein, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 5110 of 2017 arising out of GRP Patna Junction P.S. Case No. 425 of 2017.
