The petitioner seeks bail in a case registered under Section 366 of the Indian Penal Code.

Prosecution case, in short, is that the informant's daughter, namely, Pratibha Kumari after attending the School was missing. It is further alleged that the informant received a SMS from the mobile belongs to the petitioner that Pratibha Kumari resides with him and she will reside whole life with him.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.19054 of 2019(3) dt.16-05-2019 2/2 against the petitioner. In course of investigation, the statement of the victim has been recorded under Section 164 of Cr.P.C. She has not supported the allegations made in the F.I.R. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri, Rohtas in connection with Tilauthu P.S. case No.121 of 2018.
